Serving of a Non-Molestation Order
Many people in the UK suffer Domestic Violence. The Government is making it a priority to tackle and deal with Domestic Violence be it psychological, physical, sexual, financial or emotional abuse.
There are many organisations and charities that will help you deal with and escape the abuse. There are also some solicitors which still offer legal aid but you must supply evidence of Domestic abuse. Click here to view guidance and template letters. In order to obtain a Non-Molestation Order usually involves issuing Court proceedings against the Respondent and service of a Non-Molestation Order, a Prohibited Steps Order an Occupation Order against them.
Once granted the Order will provide some form of protection for the Applicant. The Respondent may be arrested if he or she breaches the terms of the Order. The Order may prevent amongst others things:-
· Use or threaten unlawful violence towards the applicant;
· Communication with the Applicant whether by letter, text or other means of communication other than through his or her Solicitor;
· Coming within so many metres of a property;
· Encouraging or instructing any other person to do anything which is forbidden by the terms of the Order
The Non-molestation Order will need serving on the Respondent which will then give the Applicant the protection of the Order the Process Server may also lodge a copy of the Order with the Police so they have a record of it having being served.
Once the Instructions are received we will carry out service. We will always carry out three attempts of service, each time gathering information from neighbours to ascertain the best time to call in order to secure a successful serve.
Upon Successful service, the Document will be posted Special Delivery or handed back to you with the required Statement of Service or sworn Affidavit to confirm the Order has been served.
